Terms of Service

These Terms govern your use of ThriveBiome.ai and its tools (the "Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Not medical advice

The Service provides educational and informational estimates only. It is not a medical device, does not diagnose, treat, cure, or prevent any disease, and does not create a clinician–patient relationship. Always consult a qualified healthcare professional before changing medications, supplements, diet, or exercise. In an emergency, call 911.

2. Eligibility and accounts

You must be at least 18 years old.
Provide accurate information and keep your credentials confidential. You are responsible for activity under your account.
Notify us promptly at nikolay@thrivebiome.ai of any unauthorized use.

3. Acceptable use

You agree not to: misuse or disrupt the Service; attempt to access other users' data; reverse-engineer, scrape, or resell the Service; upload unlawful content or data you have no right to share; or use the Service to provide medical services to others.

4. Your data

You retain ownership of the data you submit. You grant us a limited license to process it solely to provide and improve the Service, as described in the Privacy Policy.

5. Subscriptions and payments

Some features may require a paid plan. Fees, billing cycles, and renewal terms are shown at purchase. Subscriptions renew automatically until cancelled; you can cancel anytime, effective at the end of the current billing period. Except where required by law, fees are non-refundable.

6. Intellectual property

The Service, including its software, algorithms, models, content, and branding, is owned by ThriveBiome.ai and protected by intellectual-property laws. No rights are granted except as expressly stated here.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Estimates are based on published research models and the data you provide, and may be inaccurate.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRIVEBIOME.AI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY HEALTH DECISIONS MADE IN RELIANCE ON THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$100.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for violation of these Terms or to protect the Service or other users.

10. Changes

We may update these Terms. Material changes will be announced by email or in the Service; continued use after the effective date means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in San Mateo County, California.
